Purposes and legal basis of processing. Legitimate interests pursued

Data is collected, processed and stored for the following purposes:

  1. to comply with the legal and tax obligations to which the Controller is subject;
  2. to reply to users' requests and, in the context of contracts to which the Client is a party, to take the pre-contractual steps requested;
  3. to establish, exercise or defend legal claims, in pursuit of the legitimate interest identified by the Controller on the basis of a balancing of interests;
  4. to send commercial communications about products and services similar to those already purchased;
  5. with specific consent, to send commercial communications about products and services;
  6. to ensure the operation and security of the website, through browsing data.

Processing for purposes a) and b) does not require consent, as it is necessary to comply with legal obligations or to perform a contract or pre-contractual steps (Art. 6(1)(b) and (c) GDPR). Processing for purposes c) and f) is based on the Controller's legitimate interest in protecting its rights and the security of the website (Art. 6(1)(f) GDPR). Processing for purpose d) does not require consent under Art. 130(4) of the Italian Code. Processing for purpose e) is based on consent (Art. 6(1)(a) GDPR), which can be withdrawn at any time.

Data sent through the contact form is used solely to reply to the request; the checkbox in the form confirms that this notice has been read. Browsing data is not associated with other personal information and is used only to ensure the proper operation and security of the website and to establish liability in the event of possible computer crimes. Website usage statistics are collected with Google Analytics only with prior consent, as described in the Cookie Policy.

Provision of data and consequences of not providing it

Providing data for purposes a) and b) is a legal and contractual obligation respectively: without it, the Controller cannot reply to requests or establish or continue a relationship with the Client. Providing data for purpose e) is optional, and not giving consent has no consequence other than not receiving commercial communications.

Recipients or categories of recipients

  • employees and collaborators of the Controller;
  • providers of hosting, email and IT infrastructure services;
  • public or private entities used by the Controller for activities instrumental to the purposes above, or to which the Controller is required to communicate the data under legal or contractual obligations.

Data is not disseminated.

Transfer of data outside the European Union

The exception is third-party services enabled only with prior consent, described in the Cookie Policy (the Google Maps map and Google Analytics), for which please refer to Google's privacy policy.

Automated decision-making

Data is not subject to automated decision-making, including profiling (Art. 22 GDPR).

Retention period

Data is retained for as long as necessary for the purposes for which it was collected and, in any case, for no longer than the limitation period of the rights that may be enforced by or against the Controller, as applicable from time to time, without prejudice to retention obligations set by law (for example for tax purposes). Data processed on the basis of consent is retained until consent is withdrawn.

Under Articles 15 to 22 GDPR, each data subject may at any time:

  1. obtain confirmation as to whether personal data concerning them is being processed, and access the data and information on the processing, including a copy (Art. 15);

  7. withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal (Art. 7(3)).

Data subjects also have the right to lodge a complaint with the competent supervisory authority: in Italy the Garante per la protezione dei dati personali, www.garanteprivacy.it, or the authority of their own EU country (Art. 77).
