Data controller

The data controller is PC Web Agency – Via C. Treves, 24 – 88046 Lamezia Terme (CZ) Italy, email info@pcwebagency.it, which ensures compliance with data protection legislation by providing the following information on the processing of data communicated or otherwise collected.

Purposes and legal basis of processing. Legitimate interests pursued

Data provided by users through forms is collected, processed and stored for the following purposes:

  1. to comply with the legal and tax obligations to which the Controller is subject;
  2. in the context of performing contracts to which the Client is a party, or of taking pre-contractual steps at the Client's request;
  3. where necessary to establish, exercise or defend legal claims, in pursuit of the legitimate interest that the Controller has identified on the basis of a balancing of interests;
  4. to send commercial communications about products and services similar to those already purchased;
  5. with specific consent, to send commercial communications about products and services;
  6. to ensure the operation and security of the website, through browsing data recorded by the servers (logs).

Processing for purposes a) and b) does not require the Client's consent, as it is necessary to comply with legal obligations or to perform contracts to which the Client is a party or to take pre-contractual steps at the Client's request, under Art. 6(1)(b) and (c) GDPR. Processing for purpose c) does not require the Client's consent, as it is necessary for the legitimate interest of the Controller, under Art. 6(1)(f) GDPR. Processing for purpose d) does not require the Client's consent, under Art. 130(4) of the Italian Code.

For purpose f), some data whose transmission is implicit in the use of Internet protocols is collected (for example IP addresses, date and time of the request, type of browser and device). This data is not associated with other personal information and is used solely to ensure the proper operation and security of the website and to establish liability in the event of possible computer crimes. Website usage statistics are collected with Google Analytics only with prior consent, as described in the cookie policy. The legal basis is the Controller's legitimate interest in the security of the website (Art. 6(1)(f) GDPR).

Data sent through the form on the Contact page (name, company if provided, email, phone if provided, message content) is used solely to reply to the request. The legal basis is the taking of pre-contractual steps at the data subject's request (Art. 6(1)(b) GDPR); the checkbox in the form confirms that this notice has been read and that the data subject agrees to processing for this purpose.

Provision of data and consequences of not providing it

Providing data for purposes a) and b) is a legal and contractual obligation respectively. Providing data for purpose c) is optional but necessary for the Controller's legitimate interests set out above. In all these cases, failure to provide the data will make it impossible for the Controller to establish or continue a business relationship with the Client.

Providing data for purpose e) is optional, and failure to provide it or to consent to its processing will make it impossible for the Controller to carry out the activities needed to achieve that purpose.

Recipients or categories of recipients

Data may be made accessible, disclosed or communicated to the following parties, who may be appointed by the Controller, as appropriate, as processors or persons authorised to process data:

  • employees or collaborators of the Controller in any capacity;
  • providers of hosting, email and IT infrastructure services, appointed as data processors;
  • public or private entities, natural or legal persons, used by the Controller to carry out activities instrumental to the purposes above, or to which the Controller is required to communicate the data under legal or contractual obligations.

Transfer of data outside the European Union

Data is processed on servers of providers located in the European Union and is not transferred to third countries. The exception is the Google Maps map on the Contact page and Google Analytics, both enabled only with prior consent, for which please refer to Google's privacy policy.

Automated decision-making

Data is not subject to automated decision-making, including profiling.

Retention period

Data will be retained for a maximum period equal to the limitation period of the rights that may be enforced by or against the Controller, as applicable from time to time.

Rights of access, erasure, restriction and portability

Data subjects have the rights set out in Articles 15 to 20 GDPR. By way of example, each data subject may:

  1. obtain confirmation as to whether or not personal data concerning them is being processed;
  2. where processing is taking place, obtain access to the personal data and information about the processing, and request a copy of the personal data;
  3. obtain the rectification of inaccurate personal data and the completion of incomplete personal data;
  4. obtain, where one of the conditions of Art. 17 GDPR applies, the erasure of personal data concerning them;
  5. obtain, in the cases provided for by Art. 18 GDPR, the restriction of processing;
  6. receive the personal data concerning them in a structured, commonly used and machine-readable format, and request its transmission to another controller, where technically feasible.

Data subjects also have the right to lodge a complaint with the competent supervisory authority (the Italian Data Protection Authority, www.garanteprivacy.it, or the authority of their own EU country).

Right to object and right to withdraw consent

Each data subject has the right to object at any time to the processing of their personal data carried out for the Controller's legitimate interest. In the event of objection, their personal data will no longer be processed, unless there are compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

Where consent is required for the processing of personal data, each data subject may also withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Consent can be withdrawn by writing to info@pcwebagency.it.

Privacy contact

The Controller has not appointed a Data Protection Officer (DPO), as the conditions making the appointment mandatory under Art. 37 GDPR do not apply. For any request concerning the processing of personal data and the exercise of rights, please write to info@pcwebagency.it or send a letter by post to: PC Web Agency – Via C. Treves, 24 – 88046 Lamezia Terme (CZ) Italy.
